Judge Blocks Trump’s Order Against Non-Citizen Voting, Late Ballot Counting

A federal judge on Friday issued a sweeping injunction blocking President Trump’s executive order aimed at changing election procedures, ruling that only Congress has the authority to enact such measures.

Judge Denise Casper, an Obama-appointed federal judge in Massachusetts, halted Trump’s directive requiring states to demand proof of citizenship before registering new voters. She also ruled that the Defense Department cannot enforce a citizenship requirement for military personnel registering to vote while living abroad.

Additionally, the judge blocked Trump’s attempt to penalize states that count mail-in ballots postmarked by Election Day but received afterward, stating that Congress has never prohibited the practice, and therefore Trump cannot unilaterally ban it.

“The Constitution does not grant the president any specific powers over elections,” she wrote, per the Washington Times.

The ruling marked a victory for California, which led a coalition of Democrat-led states in challenging President Trump’s executive order.

It was also the second legal win in as many days for Gov. Gavin Newsom. A day earlier, a federal judge in California blocked Trump’s attempt to federalize the National Guard in response to protest-related violence in Los Angeles. That ruling, however, was overturned for now on appeal.

Trump issued his order in March, saying he sought to return “integrity” to the election process. “The right of American citizens to have their votes properly counted and tabulated, without illegal dilution, is vital to determining the rightful winner of an election,” he wrote.

Among the measures included in Trump’s executive order was an attempt to block noncitizens from registering and voting by imposing a new proof-of-citizenship requirement.

While it is already illegal for noncitizens to vote, most states only require applicants to check a box affirming their citizenship. Trump sought to have the Election Assistance Commission, responsible for overseeing the federal voter registration form, mandate documentary proof of citizenship.

He also directed the Defense Department to apply the same requirement for Americans voting from abroad.

Frustrated by the Democratic advantage in recent elections from mail-in ballots, Trump declared that Election Day should be the final deadline for receiving valid votes. He instructed the attorney general to pursue action against states that count ballots postmarked by Election Day but received afterward.

Other provisions in the order—such as prosecuting election fraud and improving voting systems—were not challenged in court, the Times added.

In August 2024, as the November election loomed, a noted election integrity organization announced a horrifying discovery involving the nation’s highly inaccurate voter registration rolls.

A report from Fight Voter Fraud, a nonpartisan election integrity organization established in 2018, revealed that nearly 298,000 voters were double-registered across multiple states between 2016 and 2022. This includes thousands of individuals who cast ballots multiple times—up to four times—and were registered in four different states, Restoration of America reported.

“Worryingly, that includes critical battleground states whose voters will determine the winner of the Nov. 2024 presidential election,” the outlet continued, citing the group’s findings. “In Wisconsin, for instance, Fight Voter Fraud discovered 1,900 voters who were registered at least twice and 18 who voted multiple times. In Arizona, they found 2,700 double registrations and 36 double voters.”

Michigan reported nearly 3,000 double registrations and 23 cases of double-voting. In Georgia, the analysis found 6,400 double registrations and 37 instances of double voting.

The highest figures, however, are unsurprisingly found in blue states with long-standing Democratic dominance. New York had 10,500 double registrations and 222 double-voters, while California reported over 36,000 double registrations and a remarkable 732 double-voters.

“All voters are disenfranchised by others that double vote,” Fight Voter Fraud CEO Linda Szynkowicz told Restoration News. “Election officials cannot pick and choose which federal and state election laws they wish to follow. The public trust in elections need to be restored and those not wanting to follow federal and state election laws should be removed from their appointed/elected position immediately for dereliction of duty.”
